Believe it or not, nobody likes charging people with IRMAA (Income-Related Monthly Adjusted Amount), including the people whose job it is to collect IRMAA surcharges on behalf of the United States Social Security Administration. Honestly, they are just doing their job. Normally, once a determination has been made that either your own individual income or you and your spouse's combined income reaches the current IRMAA Income Table, you are responsible for paying that surcharge/penalty.
Normally, the SSA reverts to your adjusted gross income from your tax filing from the prior two years, whether it is as an individual or on a joint return. But if you have a reduction that is a direct result of one of the eight Life-Changing Events listed below, you can request an immediate review without waiting two years.
The SSA is happy to refund any monies you overpaid due to an IRMAA determination. Still, you must come prepared with copies of everything relevant to your loss/reduction of income. No pressure, just be prepared to present your case and have copies of everything with you. Present your case, inform the SSA advocate which of the 8 Life-Changing Events you qualify for, and present the evidence for your case.
WHAT DOES SSA FORM 44 DO EXACTLY
It asks Social Security to use your current, lower income instead of the two-year-old tax return they normally rely on, but only if you can substantiate that you have had a qualifying life-changing event that caused the drop in your income.
SOCIAL SECURITY ADMINISTRATION FORM SSA-44 EXPLAINED
The United States Social Security Administration Form SSA-44 ("Medicare Income-Related Monthly Adjustment Amount, Life-Changing Event") is the official Social Security form to reduce or remove an IRMAA surcharge.
Because IRMAA is based on your income from two years ago, someone who retired or lost income since then can be charged as if they still earn what they used to. SSA-44 is how you correct that.
EIGHT QUALIFYING LIFE-CHANGING EVENTS FOR IRMAA REVIEWS AND APPEALS
You are entitled to file the SSA-44 Form if one of the events below has taken place that directly impacted and lowered your income:
MARRIAGE
A DIVORCE OR ANNULMENT
PASSING OF YOUR SPOUSE
YOU OR YOUR SPOUSE RETIRED OR STOPPED WORKING
YOU OR YOUR SPOUSE REDUCED THE NUMBER OF HOURS YOU ARE WORKING
LOSS OF INCOME-PRODUCING PROPERTY THAT WAS NOT VOLUNTARY
LOSS OF PENSION INCOME
A SETTLEMENT FROM YOUR EMPLOYER
A drop in income that is not caused by one of these events (for example, simply choosing to take fewer withdrawals) does not qualify for an SSA-44 appeal. However, you can still appeal a genuine error in the tax data Social Security used.
INSTRUCTIONS FOR FILING YOUR SSA-44 FORM
Download the form from SSA.gov (search "Form SSA-44") or pick one up at your local Social Security office.
Choose your life-changing event and the date it happened.
Estimate your reduced income: your expected MAGI for the current year (and next year, if it will be lower still).
Attach proof. Depending on the event, that might be a marriage or death certificate, a divorce decree, a signed statement or letter from a former employer confirming retirement, or a pension-stop letter.
Submit it to Social Security by mail, in person at a local office, or (in some cases) by phone at 1-800-772-1213. Booking a visit first is wise.

Social Security reviews your form and documentation and, if approved, recalculates your Part B and Part D premiums using your current income, often refunding any IRMAA already withheld for the year. If it is denied, you will get a notice explaining why and can request a formal reconsideration.

Yes. If you know a qualifying event will drop your income, you can file proactively to avoid the surcharge being withheld in the first place.
HOW OFTEN DO I NEED TO REFILE MY APPEAL FOR AN IRMAA REDUCTION?
If your income stays low, Social Security generally carries the adjustment forward, but it re-verifies against your tax return each year.
IS THERE ANYTHING I CAN DO IF MY SITUATION IS NOT LISTED IN THE EIGHT LIFE-CHANGING EVENTS LIST?
You can still request a reconsideration if Social Security used incorrect or outdated income data. That is a separate appeal from the life-changing-event process.
